Welcome to Travel-Giving. These Terms of Service (“Terms”) govern your use of the website www.travel-giving.com and the services provided by Travel-Giving LLC. By accessing our website or using our services, you agree to be bound by these Terms.
1. Overview of Services
Travel-Giving provides consigned luxury travel packages to nonprofit organizations for use in charity auctions and fundraising events. Our services include:
- Curating and consigning travel packages to nonprofit organizations
- Coordinating package fulfillment for auction winners
- Providing concierge support for travel bookings
2. Definitions
- “Nonprofit Partner”: A registered 501(c)(3) or equivalent charitable organization that partners with Travel-Giving to offer travel packages at fundraising events.
- “Auction Winner” or “Traveler”: The individual or party who successfully bids on and purchases a travel package at a charity auction.
- “Travel Package”: A curated travel experience offered through Travel-Giving, including accommodations and specified inclusions.
- “Redemption Window”: The period during which an Auction Winner may book and complete their travel, as specified for each package.
3. Consignment Model
3.1 For Nonprofit Partners
- Travel packages are provided on consignment at no upfront cost to the Nonprofit Partner.
- Nonprofit Partners may sell unlimited packages, including the same destination to multiple winners.
- Payment to Travel-Giving is due only upon successful sale of a package at auction.
- Nonprofit Partners are responsible for collecting payment from Auction Winners and remitting the agreed amount to Travel-Giving per the terms of their consignment agreement.
3.2 Payment Terms
- Upon receiving payment from the Nonprofit Partner, Travel-Giving coordinates with travel partners to fulfill the package.
- Travel-Giving pays travel partners directly upon the Auction Winner's booking confirmation.
4. Auction Winner Terms
4.1 Redemption Window
All travel packages must be booked and travel completed within three (3) years from the date of purchase at auction, unless otherwise specified in the package details. This is the “Redemption Window.”
4.2 Booking Process
- Auction Winners receive access to our online booking portal and 24/7 concierge support.
- Bookings are subject to availability with our travel partners.
- Certain blackout dates may apply (major holidays, special events) as determined by individual properties and communicated during the booking process.
- Auction Winners are responsible for providing accurate traveler information for bookings.
4.3 Cancellation and Rebooking
Cancellation with Rebooking: If you need to cancel a confirmed booking, you may rebook for alternative dates, provided:
- The cancellation is made within the travel partner's cancellation policy period
- The new travel dates fall within your original 3-year Redemption Window
- Rebooking is subject to availability
No Refunds: Travel packages purchased at charity auctions are non-refundable. The purchase constitutes a charitable contribution to the Nonprofit Partner.
Expired Packages: Packages not redeemed within the Redemption Window are forfeited with no refund or credit.
4.4 Travel Responsibilities
Auction Winners are responsible for:
- Valid passports and any required visas
- Travel insurance (strongly recommended)
- Airfare and transportation to/from destinations (unless included in package)
- Incidental expenses, gratuities, and items not specified in package inclusions
- Compliance with destination entry requirements and health regulations
5. Package Inclusions and Exclusions
5.1 Included
Each package specifies its inclusions, which typically cover:
- Accommodations for the stated duration
- Specific experiences, tours, or amenities as listed
- Concierge booking support
5.2 Not Included (Unless Specified)
- Airfare and ground transportation
- Travel insurance
- Meals (unless specified)
- Gratuities and personal expenses
- Passport, visa, and vaccination fees
- Incidentals and room charges
6. Limitation of Liability
6.1 Service Provision
Travel-Giving acts as an intermediary between Nonprofit Partners, Auction Winners, and travel service providers. We are not the direct provider of travel services.
6.2 Third-Party Services
Travel experiences are provided by independent hotels, resorts, tour operators, and other third parties. Travel-Giving is not liable for:
- Acts, omissions, or negligence of travel service providers
- Changes to accommodations, amenities, or experiences by providers
- Travel disruptions due to weather, natural disasters, or force majeure events
- Personal injury, property damage, or loss during travel
6.3 Limitation
To the maximum extent permitted by law, Travel-Giving's total liability for any claim arising from our services shall not exceed the amount paid by the Nonprofit Partner to Travel-Giving for the specific package in question.
7. Indemnification
You agree to indemnify and hold harmless Travel-Giving LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
8. Intellectual Property
All content on the Travel-Giving website, including text, graphics, logos, images, and software, is the property of Travel-Giving LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
9. Modifications to Services and Terms
Travel-Giving reserves the right to:
- Modify or discontinue services at any time
- Update these Terms periodically
Material changes will be communicated via our website. Continued use of our services after changes constitutes acceptance of the revised Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in New York, NY.
11. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
12. Entire Agreement
These Terms, together with our Privacy Policy and any package-specific terms, constitute the entire agreement between you and Travel-Giving regarding your use of our services.
